1. GENERAL

Thank you for visiting our website. The protection of your personal data is important to us. We strictly comply with the legal provisions of the EU General Data Protection Regulation, the Austrian Data Protection Act and other applicable legal provisions on the protection, lawful handling and confidentiality of personal data. In the following, we would like to inform you about the processing of your data in connection with your visit to and use of the website.

3. PURPOSES OF DATA PROCESSING AND LEGAL BASIS

Website visit in general:

When you visit our website, we collect and store access data in log files (so-called log files or access logs) to ensure the permanent functionality and accessibility of the website. In this context, we process the following data or information:

  • IP address
  • Date and time of access
  • Websites from which you reach our site (referrer URL)
  • Operating system
  • Name of the internet service provider
  • Product and version information of the browser used
  • Amount of data transferred, loading time

 

The legal basis for data processing is our legitimate interest according to Art 6 Para 1 lit f DSGVO. This is to ensure the functionality, security and accessibility of the website for all site visitors and, if necessary, the collection, defence and assertion of legal claims.

You have the right to object to this data processing (data subject's right to object to data processing in the legitimate interest pursuant to Art 21 (1) DSGVO). In this case, we will only process your data if there are compelling reasons worthy of protection on our part for further processing.

It is not possible to draw any direct conclusions about your identity on the basis of the information. The data will be automatically deleted after the aforementioned purposes have been achieved.

Product enquiry/contact form:

On our website, we provide a product enquiry form and a general contact form for easy contact with us. To use these forms, please provide us with the information required so that we can process or respond to your enquiry.

We process your personal data on the basis of the legal grounds of legitimate interest Art 6 para 1 lit f DSGVO (provision of low-threshold electronic contact and communication options) and, if applicable, fulfilment of contract Art 6 para 1 lit b DSGVO (contract, pre-contractual relationship). The data or information provided via the contact forms will be used by us exclusively for the purpose of answering your enquiry, processing the product enquiry or contacting you. As an alternative to using the forms, it is possible to contact us via our contact channels (e-mail, phone call or post).

You have the right to object to data processing on the basis of legitimate interest (right of data subject to object pursuant to Art 21 (1) DSGVO). In this case, we will only process your data if there are compelling reasons worthy of protection on our part for further processing.

 

Advertising and marketing:

We may use your personal data for the purposes of advertising and marketing (transmission of promotional information by e-mail, post or promotional telephone calls/telemarketing). Our legal basis for data processing is your voluntarily given consent according to Art 6 (1) lit a DSGVO and §174 (1) and (3) TKG 2021. For all promotional contact, we take care not to violate legal regulations on permitted contact and the design of promotional information. The granting of your consent is not a prerequisite for the use of our services/for the purchase of goods or products. We cannot send you any promotional information without your consent.

You can revoke your consent at any time without stating reasons and with effect for the future by sending a message to the contact channels listed above. You can use the unsubscribe link in every newsletter to withdraw your consent (immediate deletion of data from newsletters).A revocation does not affect the lawfulness of the data processing until the time of revocation.

Data disclosure: We only pass on your data to third parties insofar as this is necessary to fulfil our objectives in the area of advertising and marketing (e.g. data transfer to e-mail providers in the processing of communication, data transfer to advertising agencies for the planning design and transmission of advertising information, data transfer to service providers for personalised printing and dispatch).

 

Jobs/Applications:

On our website you will find job offers under the heading Career, if applicable. We process personal data that you send us (e-mail) for the purpose of handling the application process, assessing whether you are suitable for the position in question and, if necessary, for carrying out the measures required in connection with the establishment of an employment relationship (transfer of employment). In individual cases, applicant data is also kept on record (in the event of non-inclusion or no vacancies, as well as consent of the applicants to the keeping of their data on record).

As a rule, the legal basis for data processing is Art 6 para 1 lit b DSGVO (contract, pre-contractual relationship). If applicants consent to their data being kept on file, the data is processed on the basis of Art 6 (1) a DSGVO. In individual cases, we also process data on the basis of legitimate interests Art 6 para 1 lit f DSGVO (e.g. collection, assertion and defence of legal claims).

We only process special categories of personal data (such as health data, degree of disability) if the applicant has consented to this or if a statutory authorisation justifies the data processing (Art 9 para 2 lit a DSGVO or Art 9 para 2 lit b DSGVO).

Data transfer: In the case of successful applications, we transmit data to the payroll accountant/tax advisor commissioned by us, the tax office, health insurance fund(s) and the pension insurance institution.

Storage period: As a rule, we delete applicant data after 6 months from the end of the respective application procedure. In individual cases, we retain data for as long as is necessary for the collection, defence and assertion of legal claims.

4. AUTOMATED DECISION-MAKING AND PROFILING

We do not use profiling measures or automated decision-making.

5. DATA DISCLOSURE AND RECIPIENTS

As a rule, we only pass on your data collected on the basis of the use of our website to the extent that this is absolutely necessary to fulfil the stated purposes (e.g. operation and maintenance of the website via external service providers, passing on data to e-mail providers in the course of communication). However, we may also be obliged by law or by the authorities to pass on data to third parties (e.g. passing on data to law enforcement agencies).

In all data transfers, we ensure that only the absolutely necessary information is transferred and comply with the data protection requirements for data transfer (e.g. strict binding of instructions in the case of order processors via Art 28 contracts, obligation to secrecy and confidentiality, obligation to fully comply with a sufficient level of protection in the processing of personal data).

6. STORAGE PERIOD OF THE DATA

Your data will only be stored for as long as is technically and organisationally necessary to achieve the stated purposes and to fulfil our legal obligations. We retain log file data for a period of 6 months. If necessary, we also retain your personal data on the legal basis of legitimate interest for certain periods of time. When determining the periods, we take care not to infringe your rights and freedoms. If the data retention is no longer necessary, we delete your data immediately.

7. DATA SUBJECT RIGHTS / YOUR RIGHTS TO THE PROTECTION OF YOUR PERSONAL DATA

You have a number of rights in relation to your personal data processed by us. You can exercise all of these rights free of charge and informally (by email, by telephone, by fax or by post), where appropriate after proving your identity, using the contact details provided. Your rights in detail:

Right to information: you can request information about the data we process informally at any time. In this case, we will inform you in writing about the data we have stored about you, the purposes for which we use it, the categories of recipients to whom we pass it on and how long we intend to continue storing it. We will comply with your request for information without delay, but within one month at the latest.

Right to deletion: You have the right to request the deletion of your data processed by us at any time. We will comply with this request if your data is no longer necessary for the purpose for which it was collected, if you revoke any existing consent, in the event of unlawful data processing or if deletion is necessary to comply with a legal obligation.

Right to rectification: If we process incorrect or incomplete data about you in error, we will of course rectify this. An informal request addressed to us is sufficient for this purpose.

Right to restriction of processing: If it is not possible to delete your data or you do not wish this to happen, but you do not consent to the use of your data beyond its storage, we are obliged to restrict the further processing of your personal data at your request.

Right to data portability: We will provide you with the data we have stored about you, which we have received on the basis of a contract or your consent, free of charge in a common file format upon your informal request. You may use this data for your own purposes and pass it on to future contractual partners. If you wish and if it is technically feasible, we will also transfer your data directly to an addressee named by you. In this case, we will inform you after the transfer has taken place. We will comply with your request without delay, but within one month at the latest.

Right to revoke consent given: You can revoke your consent to data processing at any time with effect for the future, in which case we will stop processing your data. The lawfulness of the data processing carried out up to this point is not affected by a revocation of consent.

Right to object: If we process your data on the basis of our legitimate interest, you have the right to object to the further processing of your data in accordance with the General Data Protection Regulation. If you exercise this right, we will no longer process your data for the purpose to which you have objected - unless there are legitimate grounds on our side for further processing which override your interests, rights and freedoms, or the processing is for the assertion, exercise or defence of legal claims.

8. RIGHT OF COMPLAINT

The EU General Data Protection Regulation and the Austrian Data Protection Act guarantee you the above-mentioned rights in the area of data protection. If you believe that any of these rights have been violated by us, you have the possibility to complain to a data protection supervisory authority. The supervisory authority in Austria is the Austrian Data Protection Authority, Barichgasse 40-42, 1030 Vienna. Claims against us to which you are entitled on the basis of other legal grounds remain unaffected by this.

9. DATA SECURITY

We take all necessary and appropriate technical and organisational security measures to protect your personal data from loss and misuse. Your data is stored in a secure, state-of-the-art operating environment.

Access to our website is secured via HTTPS. This means that communication between your terminal device and our servers is encrypted.

On our website you may find links to websites for which other organisations, institutions or companies are responsible. Please refer to the relevant data protection information for details of the extent to which they collect or process personal data. You will recognise a link to another website by the fact that a new browser window/tab will open and a new address or URL will be displayed.
